Try shifting the placement location slightly toward the pad that is not soldered. This is assuming it is always standing up on the same pad

You need to post a picture or describe your geometry better. Is this a through hole via in pad or is the via offset from the pad with no soldermask in between?

I do think that the designer goofed, and used too large vias. I believe he only used on size via on the entire board, regardless of whether it was in a pad, or out on the board. I have seen vias in pad work, though. From a manufacturing standpoint

You're correct. This design will have a record amount of 0402 rework for tombstoning and misalignments. Suggest that the pads on each end of all components be the same size in order to balance wetting forces during reflow.
